new e-commerce directive 2011?

Hi All,

I was reading around about the EU e-commerce directive, and it appears that the 97/7 directive on E-commerce will be amended by a new EU directive on consumer rights
see http://www.europarl.europa.eu/sides/getDoc.do?pubRef=-//EP//TEXT+TA+P7-TA-2011-0293+0+DOC+XML+V0//EN

This new directive is undergoing formal approval by EU Council of Ministers and should be published this fall and transposed in national law by 2013
http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/11/450&format=HTML&aged=0&language=EN&guiLanguage=en

I didn't have the time yet to read it thoroughly. However for a very high level summary of what will change see:

What is your opinion about it?

Salva

  1. Hi Salva,

Really interesting stuff. I'm just getting into the first bits of literature in this area but this legislation looks like an interesting new development. Again, like you, it will take some time to go through it and work out some of the implications (and perhaps problems) with it...

It links together Unfair contract terms, Sales and Guarantees, Doorstep Selling and Distance Selling (which we cover in some detail it seems, in the module) for pretty much all B2C transactions...

Do you happen to know what sort of evaluation they did of the existing legislation re: consumer protection before putting this forward in 2008?

    Cheers,

    John
